One of the three basics that must be proven in order to win a trade dress case, is the likelihood of confusion.
In other words, would someone think they're buying one thing but really getting another, such as might happen with shoes or pills or whatever.
Does anyone think that a normal person would actually confuse a Samsung Galaxy (especially with that huge "Samsung" on it) with an Apple iPhone when they're buying it?
I mean, is Apple going to claim that they're losing sales because the Galaxy is so close to the iPhone that people can't tell the difference? If so, that sure doesn't say much for the iPhone. Or it says a lot for the Galaxy.

Still, it's ridiculous that Apple's Top-Of-The-Line machines don't come STANDARD with 1 gig of ram. I can guarantee they will when they come out next month.

In this day and age, 1 GB should be table stakes, especially when you're dealing with Pro machines - I would bet that most PowerMac owners upgrade to at least 2 GB of RAM standard as it is. Throw on top of that the fact that Leopard is coming out in (presumably) 6 months, give or take, and I'm sure that 1 GB will be required to run that with any degree of smoothness as well.

My district here received their phones today...
Out of 68 PINs generated, only 11 phones were sent. Only to 4 stores and one of the stores that received the most phones did not even generate P any PINs. System was screwed up like I thought it would be with Radio Shack.
Out of the 11 phones 10 are 16GB and 1 32GB. The store that generated the most PINs did not receive any phones at all.
Anyone shocked... I know I am not being I worked for Radio Shack for 7 years.

According to Radio Shack, the full, non-contract price, for the iPhone 4 will be $649.99 for the 16GB and $749.99 for the 32GB.
Seems pretty high to me.

One year ago I was being driven nuts by my three office Windows machines (one custom built, two compaqs). Relatively new machines but it was one damned thing after another. A virus here (with Norton installed) a corrupt file there, a dead hard drive here, a spyware infestation there...and then the anti-idiot Windows warnings at every turn (Are you sure you want to do that? Really really sure. Can't I talk you out of that?) I was at wit's end. I was reinstalling the operating system about every 6 to 9 months. I was convinced by a rep at compusa to try a mac. Now I have no windows machines and four macs. No longer do I wonder what new horror is going to happen and cause me endless hours to fix.
I have had zero hardware problems, and of course, no problems with virus's etc. Life is good. I really think that my experience with windows machines is not all that uncommon. Apple stuff just seems better designed and built.
I think that it is easy to forget just how much better (not perfect) this Apple stuff really is than the Windows world.

Even if that were true, so what? Apple Records was not a competitor of Apple Computer. Trademark law allows multiple companies to have the same trademark so long as they don't sell the same type of products in the same location. This is why you can have a 100 companies like "AAA Locksmith, AAA Laundry," etc. Or you can have "Hollywood Video" in Michigan being totally different than "Hollywood Video" everywhere else [interesting story that. I may have the state wrong.]
Only truly "famous" marks (e.g. Coke, McDonalds, etc.) which can be "diluted" by use with other types of products are protected against this sort of thing.
But App Store is like Coke, right? Of course it's ok if Apple does it. They've becoming one of the most hypocritical companies on the planet. Maybe Steve suffers from extreme paranoia?

Are you serious? Your comments are not only incorrect but just flat out ignorant. Whoever said that angry birds is not available on android obviously can't read or just does not know how to use the app store because I have all three on my Thunderbolt and they are full versions and they were free to boot. So before you go make comments about people being ignorant you might want to do some research first!! And why do people keep saying we are getting throttled?? I am using between 8-10 gigs a month on LTE and I am still hitting mid 30's in download speeds so if I am getting throttled then I would hate to see how fast the network really is!! Plus I get unlimited data and all the 4G I can use. And I hate to tell you but the iphone is seriously outdated, look at benchmark test, download tests etc and on top of that the flaws the phone has physically and internally like the way it delivers messages and mail is absolutely terrible. It is not even close to the top phone on the market anymore and has not been for several months now and its only going to get worse!! So if people think that most consumers will just wait it out for the next iphone because it is an iphone is sadly mistaken, its not going to happen. Why would you when android has at the moment passed apple on every standard out there?Are you serious? The Moto Droid (i.e.: the original one) is slower than molasses. You cannot be talking about the original Verizon Droid. That phone under-delivered out the gate. As a side note, I laughed heartily last night when my sister-in-law asked if I had Angry Birds on my iPhone or iPad because her mom loved that game. Her husband, my wife's brother, who owns a Motorola Droid and a Xoom and is a huge Android enthusiast promptly answered her saying "that Angry Birds is only available on Android". I proceeded to show him the number of "Angry Birds" games available on iOS. Made me realize that Android enthusiasts often don't know that there is something better out there, and yet Apple enthusiasts are called "ignorant, stupid, and sheep". His response was to show me an app he had that could automatically throttle his CPU down to save battery when the phone was not in heavy use. I admitted that I did not have that capability, but that I also did not need it. The moral of the story was, if you want really useful apps and games and fantastic user experience and tight integration with a suite of great (albeit sometimes expensive) products, then you buy Apple. If you want a heterogenous computing environment, your greatest apps to come from Google, and the ability to throttle the clock-speed on your smartphone's CPU, then Android is for you.

Google would have you believe that people prefer Android. The truth of the matter is that the people who don't care about having a smartphone or not just choose the best "free phone" or BOGO option that the carrier offers -- if that option happens to be Android, then sure Android commands a greater market share of the growing smartphone market. Those customers will never care what their mobile OS is -- they were just looking to get what they could for free (or cheap). Its like asking somebody if they would prefer the Honda or Hyundai -- most would prefer the Honda, but many may settle for the Hyundai if it is cheaper. But when you take cost out of the equation then the story changes. The moral of that story is that Apple needs a cheaper entry point for an iOS smartphone if they want to command market share and especially to put their phones in the hands of more teenagers.

If you are supporting non-intervention, than I disagree. I support the notion that the UN (using member-nations' pooled military or civilian assets) should be able to intervene in a nation's affairs if it is thought necessary to either 1) protect other nations from harm or 2) protect a nation's own people from its government, or in the case of a civil war, one or more factions.
With that being said, the UN has many flaws and I am not satisfied with the way things are done. But I do feel that intervention is sometimes necessary, if imperfect.
That is totally reasonable and understandable, although I do disagree. I can't with good heart support sending my neighbors son/daughter overseas to fight for another people.
I just find it pretty disgusting when we have the VP going on the record talking out his arse about "Unless we are attacked or unless there is proof we are about to be attacked", then a couple years later nary a peep when we start bombing a foreign country that is not even close to a threat to us. For most people the ipad is more useful than the air anyway imo. Yes i owned an air, the ipad 1, and now the ipad 2 and the air was just a watered down macbook pro more than the ipad is a scaled up ipod touch
